After having signed for receipt of goods, recipient discovers damage (hidden damage)


Goods are delivered against receipt. Recipient will examine the goods and sign to confirm that the number of items and the visible condition of the goods comply with the information stated in the consignment information / transport document. From time to time a situation arises when damage is discovered only when the packaging has been removed and the driver has gone.


The Road Transport Act §, 40, 1st subsection, states:
In relation to domestic transport, the person who claims compensation for partial loss or damage of the goods, or delayed delivery, shall inform the carrier of the situation without undue delay. If he fails to supply such information, he may later only claim compensation in case the carrier has exercised intent or gross negligence.

Damage discovered subsequent to delivery will be handled with consideration both to the recipient and the carrier. It is presumed that the damage is likely to have occurred between the time of handing in of the goods and the time of delivery. It is further presumed that the goods have been packed and/or examined by sender in Norway and that the product has not been exposed to internal removal / warehousing delayed to/been post-transported to final user, and was packed in such a way that the goods were enabled to withstand the normal strain of transport.

The damaged goods must be stored until the compensation question has been clarified.

Notification of hidden damage
The recipient shall notify Tollpost Globe of the damage within 4 (four) hours subsequent to delivery of the goods, normal business hours taken into account. Have the goods been delivered at 1300 hrs, the time limit will consequently be 0900 hrs on the following working day. The damage should be notified by telephone (+47)09300 or e-mail 09300@tollpost.no , consignment number to be included in the notification.

In cases where the purchase agreement states that the sender is responsible for the goods during transport, the recipient will notify the sender that Tollpost Globe has been notified of the damage, in order for the sender to take over responsibility for claiming compensation.

In case the damage is “of minor character” and the product may be used, the recipient may claim a relative compensation.

Tollpost Globe reserve themselves the right to inspect the product.

Claiming compensation Claims for damages should be sent via e-mail to erstatning@tollpost.no or by letter to Tollpost Globe AS, SRA, Box 6441 Etterstad, N-0605 Oslo, Norway. The claim for damages should be documented with photographs of the packing material and the damaged goods. In addition, a short description should be given of “receipt of goods”, what the damage consists in / extent of damage, plus type of goods. The claim for damages must include an amount of NOK documented with a copy of the invoice between seller and purchaser (commercial invoice). Account number must be included.

The claim for damages will, subsequent to receipt by Tollpost Globe, be handled in accordance with the regulations stated in the Road Transport Act. In cases of full compensation, Tollpost Globe may claim the compensated goods as their own.
